Catalog Merchant License
Commercial physical print-and-sell rights for a specific building catalog. This license does not allow selling or publicly distributing digital files.

§ 1 Scope and grant
(1) By completing the Stripe checkout for a Catalog Merchant License product and maintaining an active paid subscription, you receive a non-exclusive license from Townsmith to commercially print and sell physical copies of the buildings identified in the Building List for that product.
(2) Townsmith owns the intellectual property rights in the listed buildings and related Townsmith geometry. This license does not transfer ownership of those rights to you or to anyone else.
(3) The Digital merchant linked to the Catalog product may distribute the digital files for those buildings under rights granted by Townsmith (for example under Merchant License Digital). That Digital merchant does not own the IP in the buildings and cannot transfer Townsmith IP to you.
(4) The Building List is the list linked from the Stripe product description for the Catalog product you subscribed to. That product description also links to these terms.
(5) Your rights are limited to the buildings on that Building List. You do not receive rights to other Townsmith models, catalogs, or software exports.
(6) Each Catalog product has its own Stripe product and its own Building List. Rights under one Catalog product do not extend to another.
§ 2 Building List
(1) The Building List for your Catalog product may grow, shrink, or otherwise change at any time. The Digital merchant linked to that Catalog product controls the list content and any list URL updates shown for that product.
(2) Townsmith does not guarantee the content, completeness, availability, or stability of the Building List, list URL, or related files.
(3) If the Digital merchant vanishes, stops supporting the catalog, or stops paying Townsmith, your Catalog Merchant License remains valid while you keep paying Townsmith for that Catalog product, subject to these terms. Townsmith is not liable for the merchant's disappearance or for broken list or download links.
§ 3 Licensee
(1) No Townsmith account is required. The license is tied to the Stripe customer identity used at checkout (including the e-mail collected by Stripe).
(2) The license is not transferable and not resellable as a license.
(3) Employees or contractors of the licensee may use it only for that licensee's business, not for their own side sales.
§ 4 File delivery
(1) The Digital merchant linked to the Catalog product delivers the digital files for the listed buildings (for example via their own store or download page). That delivery is a distribution service only. It does not make the Digital merchant the IP owner of the buildings.
(2) Townsmith remains the licensor and IP owner, grants the print-and-sell rights described here, and processes subscription billing. Townsmith does not promise to host, update, or support delivery of the catalog files.
§ 5 Permitted sales
(1) You may sell physical prints of buildings that are on the current Building List for your Catalog product, using files delivered for that catalog.
(2) Accepted physical formats: resin and FDM 3D printing, and mold casting.
(3) Restricted format: injection molding.
(4) Townsmith may add further restricted formats with notice under § 12.
§ 6 Prohibited uses
(1) You may not sell, share publicly, or commercially distribute digital files of the listed buildings or any other Townsmith models under this license.
(2) You may not sell redesigned or externally kitbashed geometry. Prints must match the listed buildings as provided for that catalog. Redesign, third-party mesh remix, or "inspired by" variants are not allowed.
(3) You may not claim copyright ownership of Townsmith designs, register them as your IP, wrap them as NFTs, or sell them into AI training / dataset products.
(4) You may not use Townsmith trademarks as your shop or brand name, or imply Townsmith endorsement of your storefront or of the Digital merchant.
§ 7 Attribution
(1) On every commercial listing (online or offline materials where the product is offered) you must show Made with Townsmith and a link to https://townsmith.de.
(2) You must also credit the Digital merchant or catalog as named on the Catalog product you subscribed to.
§ 8 Territory and exclusivity
The license is worldwide and non-exclusive. Townsmith may license any number of Catalog merchants for the same or different catalogs.
§ 9 End of subscription
(1) New commercial printing and sales under this license stop when the subscription for that Catalog product is not active.
(2) Physical goods already sold to customers stay with those customers.
§ 10 Costs
(1) The Catalog Merchant License is sold as a Stripe subscription for the specific Catalog product you selected.
(2) Pricing and billing interval are as shown at Stripe checkout for that product.
§ 11 Warranty and liability
(1) The license and any related files are provided as-is. Townsmith does not warrant printability, slicer compatibility, fitness for a particular purpose, merchant revenue, or ongoing availability of the Building List or files.
(2) Liability is limited as far as German law allows. Mandatory liability for intent, gross negligence, injury, or non-waivable consumer rights remains.
(3) You are responsible for your storefront, customer support, taxes, and consumer duties on your sales.
(4) Townsmith owns the IP in the listed buildings as stated in § 1. Townsmith is still not liable for acts or omissions of the Digital merchant as a distributor, including list changes, file delivery failures, or the merchant ceasing operations.
§ 12 Changes to these terms
(1) Townsmith may update these terms for ongoing subscriptions. Material changes will be announced with prior notice (for example by e-mail to the Stripe customer e-mail).
(2) Changes take effect on the stated date (at least 6 weeks after notice unless a later date is stated) or as otherwise notified. Continued subscription after the effective date means acceptance.
§ 13 Breach
(1) Townsmith may suspend or terminate this subscription for material breach, require immediate correction of listings, and pursue remedies under German law (including copyright).
(2) Clear infringement may be cut off immediately. Fixable attribution mistakes may receive a short cure window (for example 7 days).
§ 14 Governing law
(1) The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and excluding conflict-of-laws rules that would lead to a different law. Mandatory consumer-protection rules that apply under Rom-I or other mandatory law remain unaffected.
(2) If you are not a consumer, the exclusive place of jurisdiction is Saarbrücken, Germany. If you are a consumer, the statutory jurisdiction rules apply (including Brussels Ia consumer jurisdiction where applicable).
(3) These terms are published in English. If Townsmith publishes an official German version of the same terms version, the German text controls in case of conflict. Until then, the English text controls. Language choice does not limit mandatory consumer rights.
